เราแต่งงานกับ H1B เมื่อเดือนที่แล้ว แล้วตอนนี้เราถือวีซ่านักเรียนอยู่ค่ะ จะเรียนจบคอร์สอีกสองเดือนข้างหน้านี้ ตอนนี้เรายังไม่แน่ใจว่าจะเรียนต่อดีไหมก็เลยจะเปลี่ยนเป็นวีซ่าH4ค่ะ เนื่องด้วยปัจจัยหลายอย่างเช่นค่าเทอมเท่ากับเรสสิเด้นซ์แล้วเราก็อาจจะไม่ลงฟูล์ไทม์หนะค่ะ
เราก็เสิจข้อมูลมาบ้างว่าสามารถเปลี่ยนวีซ่าที่นี่ได้เลย อาจจะจ้างทนาย พอกลับไทยก็เอาใบแอพพรูฟไปยื่นที่กงศุลเพื่อขอสแตมป์ใช่ไหมคะ
คำถามคือ
1. ถ้าเราเปลี่ยนที่นี่แล้วไปยื่นที่ไทยใช้เวลานานเท่าไหร่คะที่ไทย ต้องซื้อพินกรอกเอกสารอะไรอีกหรือเปล่า มีโอกาสจะโดนรีเจกได้ด้วยกรณีใดบ้าง
2. ถ้าเรากลับไปทำใหม่ที่ไทย ก็ยื่นเรื่องเหมือนตอนที่เราขอ F1 เลยใช่ไหมคะ คือจองวัน เตรียมเอกสาร สัมภาษณ์ใช่ไหมคะ มีโอกาสโดนรีเจกไหม เราจดทะเบียนที่อเมริกา แล้วต้องไปจดที่ไทยอีกไหม หรือเอาใบทะเบียนสมรสไปแปล หรือว่าไม่ต้องแปล
3. วิธีไหนดีกว่ากันคะ ถ้าไม่มีปัญหาด้านเวลา เรากำลังคิดแบบที่หนึ่งไว้อะค่ะ ดูมันไม่ยุ่งยากเท่าไหร่แต่ต้องจ่ายค่าทนายหลายบาทอยู่
4. เราลองเซิจดูส่วนใหญ่คนที่ถือวีซ่า H4 มักจะเปลี่ยนเป็น F1 กันเพื่อขอ OPT แต่ของเราแฟนยื่นกรีนการ์ดให้เราได้พร้อมเค้า ซึ่งจะได้อีกประมาณปีครึ่ง ถ้าเป็นอย่างนั้น OPT ด้วยกรีนการ์ดก็ได้ใช่ไหมคะ หรือควรจะถือ F1 เผื่อมีอะไรเปลี่ยนแปลง เช่นไม่ได้กรีนการ์ด

-Completed Non-immigration Visa application H4 visa application form DS-160 Separate form for each applicant. [ Sample Form DS-160]
-Application US visa fee receipt.
-US Visa Interview Appointment Letter which you get in your email inbox at the time of taking a US visa appointment.
Valid passport of each applicant.
-One photograph: 2 and 2 inches square (50 mm square) for each applicant, showing full face, without head covering, against a light background. To be used in the application Form. US consulates are very particular about the Photographs specification. You must follow these guidelines for photographs. Check out the guidelines for photograph required for US visa.
-Receipt of US Visa application fee. Read more about the US visa fee here.
-If the applicant is below 14 yrs of age, Original Birth Certificate of this applicant (child) is required.
-Original marriage certificate.
-Entire wedding photo album.
-A copy of marriage invitation card of both the families.
-Complete copy of all the pages of your principal H1's passport.
-Copy of principal H1 holders approved petition I797, form I-129 and LCA.
-H1B visa holder's employment verification letter. See a sample employment verification letter.
-Pay stubs from principal applicant's current place of work and income tax return (if the H1 holder is already working in U.S.)
